Terms of Service

These Terms of Service ("Terms") govern access to and use of the Feedforward platform ("Service"), operated from Spain. By signing a subscription agreement or accessing the Service, the contracting institution ("Client") agrees to these Terms. Individual users (members, parents, administrators, and professors) access the Service under the authority of the Client and are also bound by these Terms.

Feedforward is a B2B anonymous feedback platform for educational institutions. It enables members to submit anonymous concerns, upvote submissions, and receive public responses from administrators. Administrators may access dashboards, moderation tools, and AI-generated summary digests. Professors may view feedback scoped to their class.

The Service is provided "as is" and may be updated, modified, or expanded over time. Material changes to functionality will be communicated to the Client with reasonable notice.

Clients and their users agree not to:

• Use anonymity features to harass, threaten, defame, or discriminate against any individual.
• Submit knowingly false or malicious content.
• Attempt to reverse-engineer the anonymisation system or identify other users.
• Circumvent access controls, probe for vulnerabilities, or interfere with the Service's operation.
• Use the Service for any purpose that violates applicable law, including the GDPR, Spain's LOPDGDD, and the Thailand PDPA where applicable.

Feedforward reserves the right to suspend access immediately upon credible evidence of a serious breach of these obligations.

The Client is the data controller for its users' personal data and is responsible for:

• Obtaining any required consents (including parental consent for minors) before granting access to the platform.
• Communicating these Terms and the Privacy Policy to its users.
• Ensuring that use of the Service complies with the laws of the Client's jurisdiction, including Thailand's PDPA where the Client is based in Thailand.
• Maintaining the security of administrator credentials.

Feedforward processes personal data on behalf of the Client as a data processor. The specific terms of that processing (including subject matter, duration, nature, purpose, type of data, and categories of data subjects) are set out in our Privacy Policy and any separate Data Processing Agreement ("DPA") entered into with the Client. In the event of conflict between these Terms and a signed DPA, the DPA prevails.

Feedforward retains all rights in the platform, its code, design, and AI-generated outputs. Content submitted by users (feedback text, responses) remains the property of the Client. Feedforward is granted a limited licence to process and display such content solely to deliver the Service.

To the maximum extent permitted by applicable law, Feedforward shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of or inability to use the Service, including but not limited to loss of data, loss of revenue, or reputational harm, even if Feedforward has been advised of the possibility of such damages.

Feedforward's total aggregate liability to the Client for any claim arising under these Terms shall not exceed the fees paid by the Client in the twelve months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Feedforward makes reasonable efforts to maintain availability but does not guarantee uninterrupted access. Planned maintenance will be communicated in advance where practicable. The Service is not warranted to be error-free or suitable for any particular purpose.

These Terms remain in effect for the duration of the Client's subscription. Either party may terminate for material breach upon 30 days' written notice if the breach is not cured within that period. Feedforward may terminate immediately for breach of Section 3 (Acceptable Use) or non-payment. Upon termination, the Client's data will be deleted within 90 days as described in the Privacy Policy.

These Terms are governed by the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, except where mandatory consumer protection laws in the Client's jurisdiction require otherwise.

For Clients based in Thailand, we acknowledge that local mandatory provisions of Thai law (including those arising under the PDPA) may apply concurrently and take precedence to the extent required by Thai law.

Feedforward may revise these Terms from time to time. Material changes will be communicated with at least 14 days' notice via the platform or email to the Client. Continued use after the effective date constitutes acceptance. If you do not accept the revised Terms, you may terminate your subscription before the effective date.
